U.S. Supreme Court's decision to reverse Roe v. Wade: Employer resources coming soon

Marsh McLennan Agency (MMA) has reviewed the U.S. Supreme Court’s decision to reverse Roe v. Wade and return decisions regarding the access to and coverage for abortion and abortion-related services to state legislatures. MMA is closely monitoring the resulting and ongoing state legislative and associated legal activity. We understand employers may be interested in exploring options to provide access to these services to employees living in states prohibiting or otherwise significantly restricting them.

MMA is preparing the following content for delivery to our clients in July:

  • A written guide that addresses the following topics:
    • A high-level overview of the Supreme Court’s decision;
    • Previously publicized state action on “trigger” laws and other future-state service prohibitions, and the gaps in access to services that may result across certain U.S. states;
    • Options to provide access to services for employees living in gap areas, including:
      • Major medical coverage;
      • Other group health plan options (e.g. spending account plans and EAPs); and
      • Potential non-group health plan options.
    • Tax implications for reimbursing related travel expenses;
    • Data privacy and a variety of other potential compliance issues; and
    • Certain issues specific to Native Americans and access to services on tribal land.
